California Plastic Packaging Legislation Summarized

On May 22, 2023, attorneys with McDermott Will & Emery issued a “Brief Overview” of legislation signed June 30, 2022 by the Governor of California, SB 54, the Plastic Pollution Prevention and Packaging Producer Responsibility Act “… that requires that by 2032: 100% of packaging in the state be recyclable or compostable … 25% cut in plastic packaging; and 65% of all single-use plastic packaging be recycled … Manufacturers will create a product responsibility organization to increase packaging recycling … shifts the plastic pollution burden from consumers to the plastics industry … establishes a new extended producer responsibility (EPR) program … [that] gives the primary responsibility for managing products after their useful life on producers or brand owners …” – MWE attorneys recommend that “… Consumer product companies continue to monitor the developments associated with SB 54 ...” - CalRecycle will host a public workshop about SB 54 on May 31, 2023 …” #PlasticWaste #SingleUsePlastic #Recycling @CalRecycle @McDermottLaw
