Recycling – New California Law on Use of the “Chasing Arrows Symbol” Explained

A January 31, 2022 Morgan Lewis “Lawflash” https://www.morganlewis.com/pubs/2022/01/california-restricts-labeling-of-recyclable-items-check-the-chasing-arrows reports that an October 2021 California law “… creates new requirements for the labeling of packaging that is intended to be disposed of in the blue curbside recycling bins … manufacturers of recyclable packaging should be prepared to assess these new restrictions and requirements and evaluate the materials and labeling used in their packaging … [The law] … prevents the use of the chasing arrows symbol on products that are not considered by the state to be recyclable … improper use of the chasing arrows symbol is also considered a deceptive or misleading claim … the law [also] imposes new recordkeeping requirements … Those that do not comply … will be subject to potential misdemeanor charges punishable by imprisonment or fines of up to $2,500.
